The BUNGA.app Social Portal is a way for adults to meet each other online.
This is a legal agreement ("Agreement") between you and BUNGA.app (Non-Profit-Organisation). Please read the Agreement carefully before free registering for the BUNGA.app service. Either you or BUNGA.app may terminate your free BUNGA.app membership at anytime, for any reason, effective upon sending written notice to the other party. BUNGA.app reserves the right to immediately suspend or terminate your access to the BUNGA.app service, without notice, upon any breach of this Agreement by you which is brought to BUNGA.app's attention.
Your membership in the BUNGA.app service is for your sole, personal use. You may not authorize others to use your membership, and you may not assign or otherwise transfer your account to any other person or entity.
Online/Mobile Conduct
As a Member, you agree that:
You are solely responsible for the content or information you publish or display (hereinafter, "post") on the free BUNGA.app service, or transmit to other BUNGA.app Members.
There is no tolerance for objectionable content. You will NOT post on the free BUNGA.app service, or transmit to other BUNGA.app members or employees, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).
You will use the free BUNGA.app service in a manner consistent with any and all applicable laws and regulations. You will not include in your profile any telephone numbers, street addresses, last names, URL's, E-mail addresses, offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and you will not post any photos containing nudity or personal information. BUNGA.app reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions.
You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk E-mail to other BUNGA.app members.
You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
You are solely responsible for your interactions with other BUNGA.app members. BUNGA.app reserves the right, but has no obligation, to monitor disputes between you and other members. Any infraction may lead to legal remedy on behalf of BUNGA.app.
Indemnity by Member
You will defend, indemnify and hold harmless BUNGA.app its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the free BUNGA.app Service, including, but not limited to, any breach by you of the terms of this Agreement.
Online Content
Opinions, advice, statements, offers, or other information or content made available through the free BUNGA.app Service are those of their respective authors and not of BUNGA.app and should not necessarily be relied upon. Such authors are solely responsible for such content. BUNGA.app does not guarantee the accuracy, completeness, or usefulness of any information on the Service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made. Under no circumstances will BUNGA.app be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on the BUNGA.app Service, or transmitted to BUNGA.app members.
WARNING - PLEASE READ: It is possible that other BUNGA.app members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the free BUNGA.app Service and that you may be involuntarily exposed to such offensive or obscene materials. Removal of Information
While we do not and cannot review every message sent by users of the free Service, and are not responsible for any content of these messages, BUNGA.app reserves the right, but are not obligated, to delete or move content including without limitation profiles, public postings and messages, that we, in our sole discretion, deem to violate the code of conduct set out above or any applicable content guidelines, or to be otherwise unacceptable. You shall remain solely responsible for the content of profiles, public postings and messages you may transmit or record to the Service or send to the users of the free BUNGA.app Service.
Proprietary Rights
BUNGA.app owns and retains other proprietary rights in the free BUNGA.app Service. The Service contains the copyrighted material, trademarks, and other proprietary information of BUNGA.app and its licensors. In addition, other members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
By posting information or content to any public area of BUNGA.app, you automatically grant, and you represent and warrant that you have the right to grant, to BUNGA.app and other BUNGA.app Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.
Information Supplied by Member
Except as provided otherwise in BUNGA.app's privacy policy, BUNGA.app will keep confidential all information supplied by you to BUNGA.app including credit card number(s), and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.
Mobile Fees and Payments
Any questions or disputes regarding billing, fees or payments should be addressed to your third party mobile phone service provider.
Disclaimer of Warranty
bUNGA.app provides the free BUNGA.app Service on an "as is" basis and grants no warranties of any kind, express, implied, statutory, in connection with the Service or in connection with any communication with BUNGA.app or its representatives, or otherwise with respect to the Service. BUNGA.app specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. BUNGA.app does not warrant that your use of the free BUNGA.app Service will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the Service will be corrected. BUNGA.app disclaims liability for, and no warranty is made with respect to, telephone service, including coverage, range, or any interruption in telephone service.
Limitation of Liability

State by State Variations
Certain jurisdictions limit the applicability of warranty disclaimers and limitations of liability so the above disclaimers of warranty and limitations of liability may not apply to you.
General Provisions
You agree that Florida law (regardless of conflicts of law principles) shall govern this Agreement, that any dispute arising out of or relating to this Agreement shall be subject to the exclusive venue of the federal and state courts in the State of Florida, and that you submit to the exclusive jurisdiction of the federal and state courts in the State of Florida in connection with the Service or this Agreement. This Agreement, accepted upon registering for the free BUNGA.app Service, contains the entire agreement between you and BUNGA.app regarding the use of the Service. This Agreement may only be amended upon notice by BUNGA.app to you, or by a writing signed by you and an authorized official of BUNGA.app Unless otherwise explicitly stated, the Terms will survive termination of your membership to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
Refund Policy
BUNGA.app will issue no refund because the BUNGA.app Service is for free.

Data processing through app stores
Before you can install our app, you may have to enter into a user agreement with an app store operator (e.g. Google or Apple). Our app is available on different app platforms, depending on your particular operating system.
In order to install and use our app via these app stores, you will need to have a valid account with the app store operator as well as a compatible device (e.g. a smartphone). BUNGA.app has no control over the collection, processing and use of personal data in this respect. The relevant app store operator will be the sole data controller of this information. If necessary, please contact the operator of the respective app store directly for information about their data processing. BUNGA.app is the data controller with respect to your personal data only when you use the BUNGA.app.
Cloudflare
In order to secure this website and optimize loading times we use a "Content Delivery Network" (CDN). This CDN is a service of Cloudflare, Inc, 101 Townsend St, San Francisco, CA 94107, USA. Use of the Cloudflare service requires website enquiries and website content to be transmitted and processed via its server. In connection with this, data is consolidated to form statistics, which cannot be deactivated.
We have entered into a processing agreement with Cloudflare on the basis of the standard contractual clauses as defined by the EU Commission on 4 June 2021 and the use of additional technical and organisational security measures.

B. Information we collect when you use our services
Your browsers and devices
We collect information about the browsers and devices you use to access our services. This enables us to tailor the user experience to your browser and/or device. For example, you may be able to see more information on a big screen than a small, and sometimes things that work with some devices will not work in others. We constantly tweak our software to deliver to best possible experience to different browsers and devices. We may also use this information in order to prevent fraudulent behavior and other abuse.
Your activity
We collect information about your activities while using our services. This can be things like your searches, members whom you interact with, view, pin, like, block, report, photos you flag and so on.
Your location information

The greatest challenge providing our kind of services is to detect and prevent scam, spam, fraud, harassment, threats, illegal activities or other kinds of abuse which are in violation of our terms of use. We use several different automated algorithms and technologies as well as manual examination of information for this purpose, and we retain data related to security issues, fraud and abuse to prevent recurrences.
While we cannot guarantee that you will not encounter abuse using our services, we can guarantee you that combatting abuse is of the highest priority. We have a number of different reporting and flagging systems in our services. We ask you to please use those systems to alert us if you encounter anyone who violates applicable laws or our terms of use.

Your profile and profile photos
Your profile and profile photos will not be publicly available. Please consider carefully what information you share. Do not disclose any contact information such as phone numbers, email addresses and other social media usernames on your profile. This can be given in private messaging with those you trust.
Because your profile will not publicly visible, it won’t also appear on public search engines and other third party sites. We do not control who reads your publicly available information and how they use this information, so please consider your privacy carefully.
Your private messages
Your private messages can be viewed by you and those you send them to. Your private messages are also checked by automatic filters and algorithms to ensure compliance with our terms of use and applicable laws. On rare occasions staff will do spot checks of your messages for the same purpose.
Service providers
We may share information with third party service providers which help us provide our services. For example, if we send an SMS to your cell phone, we use the services of a third party, and thus we must provide your cell phone number and the SMS content to them. All of our service providers and partners must agree to strict confidentiality obligations.
Advertising
We work with third party advertising partners to show you ads that we think may interest you. Our advertising partners may set and access their own cookies and web beacons on our services, and they may otherwise collect or have access to information about you which they may collect over time and across different online services.

5. Cross-border data transfers
Filipinos2Meet.com is a global service. We may transfer personal data to countries other than the country in which the data was originally collected.
Our main servers are currently located in Finnland and Germany. This may or may not change in the future. We also use Content Delivery Networks for public data such as your public photos. Content Delivery Networks distribute data to servers near the end users in order to improve access speeds and availability. Our Advertising and Analytics partners may also have servers located outside of your country of residence.
We use Standard Contractual Clauses (SCCs) to permit data transfers from the EEA, Switzerland, the UK and Brazil to other countries. These contractual clauses binds the companies involved to protect the privacy and security of your data, and gives the data the same protection it has in Europe or Brazil. This is only required by law for residents of the European Economic Area (EEA), Switzerland, the UK and Brazil, but we provide the same level of privacy and security for residents of all countries.
6. Security
We only use the finest data centers with security staff, backup power and high-quality hardware. Data is backed up at least every hour to physically separated backup servers, and we use encryption to keep your data private while in transit.
We routinely check for security vulnerabilities and attacks, and we keep our servers up-to-date with the latest security patches. If we suspect or detect any breach of security we may suspend your account. We take a "better safe than sorry approach" to security issues.
Still, no system is without failure, so we cannot guarantee absolute security. We will notify you and any applicable regulator of a breach where we are legally required to do so.
7. Data retention and deletion
We keep your personal data only as long as we need it to provide you with our services, to comply with legal or regulatory requirements, to resolve disputes, and when necessary for security purposes, fraud and abuse prevention.
A. When you delete your account
You can delete your account from from your Profile Settings. If you have forgotten your login credentials, we will ask you to verify your identity. If you cannot prove your identity, data will be retained.
When you choose to delete your account, we immediately start the process of removing it. First, we aim to immediately remove your profile from view by others using our services. Then we start the process of completely deleting the data from our storage systems. Because we backup data continuously, it may take up to 30 days for all data contained in those backup archives to be deleted.
Caution
Please note that deleted accounts cannot be restored if you regret deleting it, and that all data sent to and from deleted accounts (for example messages) also will be deleted. If you have sent important information to other users that have not yet read it, they will never be able to.
B. When your account expires
Inactive accounts might be deleted after 360 days, incomplete accounts might be deleted after 7 days, and accounts containing junk or inappropriate data might be deleted immediately.
C. Exceptions
Legal or regulatory requirements
Sometimes we must keep data as evidence in compliance with applicable laws and regulatory requirements.
Resolving disputes
If there is an outstanding issue, claim or dispute, we are required to keep the relevant information until it is resolved.
Security, fraud and abuse prevention.
We may ban those who violate applicable laws, our terms of use, or threaten our users' safety and security. When this happens, we may keep data for up to 360 days. This is to try to prevent repeated occurrences by for example preventing a user who was banned from opening a new account. Banned accounts will of course not be visible on the services anymore.
Some data from banned users may be anonymized and used to train our system to detect and prevent security breaches, fraud and abuse in the future. Such data cannot be traced back to the user and is kept for as long as our services exist.
8. Your rights
If you are located in the EEA, Switzerland and the UK, special rights set down in the General Data Protection Regulation or "GDPR" applies to you, and if you are located in Brazil, Special rights set down in the Lei Geral de Proteção de Dados or "LGPD" applies.
We will respond to all legitimate GDPR and LGPD related requests which do not infringe on trade secrets or intellectual property or the privacy of another user within 30 days as required by the GDPR, or within 15 days as required by the LGPD. This is usually free of charge, but we are allowed to charge a reasonable fee if your request is clearly unfounded, repetitive or excessive (GDPR). We may request proof of identity before we can answer your request. You have the right to complain to a data protection authority. Right of access
Also, sometimes referred to as "right of portability", you have the right to review the personal information we keep about you, and you may contact us to request a copy of your personal information. However, please note that most of your private information already is accessible to you in your account.
